Another Dispute Won – Three Employees Dismissed from Abasha City Hall Won the case in the Court of Appeal

The Senaki District Court satisfied their claim on 14 May and ordered the City Hall reinstatement of employees and payment of remuneration in the period of forced leave. The Abasha City Hall appealed the court decision to the Kutaisi Court of Appeal, but on 31 October the Court left the decision of the first instance court unchanged.
Abasha City Hall considers the reinstatement of dismissed employees premature until the court decision is handed over to them.
As for the grounds of their dismissal, according to the statement made by the Head of Audit Office of Abasha the employees were dismissed on January 12, 2018 based on the report published by the Office.
‘I had remarks with regard to improper performance of public servants. We think that their inactivity has resulted in significant material losses to the budget’ – Zviad Tsomaia said.
On the other hand, defense lawyer of dismissed employees, Sergo Makharadze, a lawyer of Confederation of Trade Unions at the same time, believes that his clients are qualified public servants.
‘The main motivation was that they wanted to dismiss them and prepared the report to justify their actions. They are very qualified employees and the satisfaction of our complaint by the judge is a good precedent’ he said.
